1. Introduction and Definitions
These terms and conditions are set to protect the rights of the service provider, customers, and the company that owns the application, and they govern your use of this electronic application as follows.
Company – Service Provider: Baims International (LLC), the actual owner of the "Baims" application.
Customers: Users of the website and electronic application of Baims International (LLC), known as "Baims."
Instructor: The instructor who provides the service displayed on the Baims application.
2. Description of Services
- Baims meets customers' needs by providing academic lectures online by instructors specialized in the subjects offered, with prices and summaries of these lectures displayed on the electronic application, allowing the customer to complete purchases directly (online) without needing to be present at the company's premises.
- The purpose of the electronic application is to provide a means and service for customers whereby lectures are displayed so the customer can play them on the application after purchase whenever they wish, within the periods specified by the Company.
3. Services Provided on the Application
- Lectures and courses are displayed on the application, some paid and some free.
- The services provided are for your use only. You may not share your account with another user or give them your credentials to access lectures and courses from their device.
- Baims has the right to contact customers to gauge their satisfaction with the services provided and to obtain any feedback from them.
- The number of views for a lecture is unlimited during a single academic semester, and Baims has the right to terminate the user's subscription to the lectures upon the end of the semester or for any other reason the team deems appropriate.
4. Prices
- The prices displayed on the electronic application are specific to the Company and are set in Kuwaiti Dinar, Saudi Riyal, Bahraini Dinar, or Jordanian Dinar. The customer is responsible for any currency conversion to other currencies.
5. Order Execution (Purchase)
- Purchases of lectures are executed immediately (online), and payment is made through the various payment methods supported by the Company in each country.
6. Intellectual Property and Permitted Use
- It is not permitted to publish the notes related to the lectures posted, or to use them for commercial purposes; they may be printed and used by the student for personal or study purposes only.
- The Company and the instructors own all rights to the content provided, including videos and designs of the lectures and courses. The customer may not use anything on the site belonging to the Company or the instructors without first consulting the Company and the instructors.
- The customer is not allowed to take screen captures (screenshots) by any means, or to share the account with another person. If the Company discovers that the customer is using the site in a way that violates these terms and conditions, the Company has the right to take appropriate measures for the violation, including suspending the account or canceling all subscriptions without referring back to the customer.
- Amounts paid will not be refunded if the customer changes their mind or purchases a lecture or course by mistake.
7. Order/Payment
- During the ordering and execution process, you must provide the Company with complete personal data, including name, phone number, and email, and write any other data or notes if any.
- Payment is made via electronic payment (online service) using the various payment methods available in each country.
- By clicking the "Confirm" button at the end of the order process, you agree to be bound by the terms and conditions stated here and those appearing anywhere else on the electronic application.
- Before placing your order, please review the terms and conditions.
- If your card issuer does not authorize the transaction for any reason, we will not be able to execute your transaction, and we will not be responsible for any delay resulting from that.
- The transaction amount will be debited from your account immediately upon submitting the order.
8. Company Contact Details
- If there is a complaint, it should be made by phone or by sending it to the email address specified in the application.
- To help us resolve any complaints quickly and satisfactorily, we advise you to submit the complaint on the same day the complained-of act occurred.
9. Disclaimer
- Baims (the service provider) agrees to make all reasonable efforts to ensure that the electronic application operates fully and without errors, but it does not guarantee that; therefore, it assumes no responsibility for any defects and/or outages in the electronic application. Accordingly, it is released from its obligations under these terms and conditions in the event of any malfunctions beyond its control that hinder operation or make providing the electronic application impossible or impractical.
- The customer bears responsibility for failure to execute their requested transactions resulting from default or breaches originating from the customer.
- The customer is subject to all terms and regulations in force at the competent government authorities in the country of residence or the place where the application is used, to the extent that they do not conflict with these terms and conditions.
10. General
- The Company reserves the right to complete or amend the terms and conditions, which the customer is authorized to review on the "Baims" application from time to time. Any changes will be displayed on the electronic application, and the customer is responsible for reviewing the terms and conditions each time they use the application. The change will take effect immediately after posting, and all subsequent dealings between the customer and the Company will be based on the new terms and conditions.
- The Company also reserves the right to suspend, restrict, or terminate access to the application at any time and for any reason.
- The Company uses the data received from the customer to fulfill its obligations under these terms and conditions as stated in its Privacy Policy.
- Regarding fraudulent statements of incorrect information, this agreement (including any documents and papers referred to here) cancels all undertakings, arrangements, mutual understandings, or previous agreements between the customer and the service provider (whether written or oral), and governs any agreement and mutual understanding regarding the subject stated herein.
- The service provider has the right to claim compensation if the customer's use of the application harms its functions, operations, business reputation, or harms its customers and their personal data, whether the harm results from an intentional or unintentional act.
- The responsibility for updating/modifying any customer data lies with the customer. Accordingly, the Company disclaims and waives liability for any errors or financial loss that may be incurred by the customer as a result of the Company's use of the customer's old or incorrect data.
- Persons under the age of sixteen, or any age deemed legally incompetent in the customer's place of residence or country, are prohibited from purchasing through the application; their parents must act on their behalf in doing so.
- Execution of transactions: Executing transactions is subject to two conditions: the Company's acceptance of the transaction requested to be executed, and the customer's acceptance of all the terms and conditions stated herein regarding the application's terms of use and its services.
- The foregoing terms and conditions constitute an indivisible whole and cannot be dealt with or applied in parts separately. In the event of a breach of any clause, the Company reserves its right to take the necessary legal measures to protect its interests at the time it deems appropriate. Any delay by the Company in taking the necessary legal measures does not constitute its approval of a violation of these terms.
11. Subscription Provisions and Re-Study (Regulatory Addition)
- Subscription period for content: From the subscription date until the end of the academic semester in which the subscription was made.
- Retaking the subject: If the student retakes the subject for any reason (failure, circumstances, or otherwise), 50% of the value of the first subscription is paid.
- Suspension/Reactivate: If the subject is deleted/withdrawn or dropped, you must contact Customer Service directly to suspend the subscription. When the subject is studied again in another academic semester, the service is reactivated free of charge.
12. Governing Law and Jurisdiction
- All transactions via the application are concluded electronically. These terms and conditions are subject to the laws in force and applicable according to the laws and rules of the countries in which the Company operates.
